What this Privacy Policy Covers

This Privacy Policy covers 1happystepmom’s treatment of the personally identifiable information 1happystepmom collects on the 1happystepmom website. This policy also covers 1happystepmom’s treatment of any personally identifiable information that 1happystepmom’s business partners share with 1happystepmom.

This policy does not apply to the practices of companies that 1happystepmom does not own or control or to people that 1happystepmom does not employ or manage.

Information Collection

1happystepmom collects a wide variety of personally identifiable information from Members (including Child Members), including, but not necessarily limited to, your first name and last name, middle initial, email address, street address, username, password, date of birth, and phone number. Personally identifiable information is collected when you register for a 1happystepmom website account, when you use certain 1happystepmom website products or services, when you visit 1happystepmom website pages, and when you enter promotions.

If the user is a child we require the Parent to submit the user’s personal information during the registration process after receiving Parental consent to collect such information. If payment is required for your level of use, at the time of registration, we collect payment information (e.g., credit card and billing address) from users over 18 years of age or from Parents of users under 18 years of age, but such information is handled and stored by a third-party payment processor, not 1happystepmom. Such third-party payment processor does not have a right to share your personally identifiable information.

1happystepmom also receives and records information on our server logs from your browser including your IP address, browser type, 1happystepmom cookie information, time spent on the website and the pages you requested. This information is collected on all users of 1happystepmom, whether or not they are Members. 1happystepmom collects this information for the following purposes: (1) to provide statistical analysis of web page traffic patterns; (2) to administer 1happystepmom; (3) to allow for auditing of our services by third parties; and (4) for marketing purposes (including potentially sharing your information with our third party partners to provide you with information about products and services they offer). We reserve the right to use a third party service to collect such anonymous visitor data on our network of sites and services. Currently, we do not use any third party services to collect anonymous visitor data on our network of sites and services. Should we elect to utilize a third party to collect such data, 1happystepmom will amend this Privacy Policy to specifically identify such third party.

Information Use

1happystepmom is a website designed to facilitate the management of your blended community’s life through features which may include, but are not necessarily limited to, schedule management tools, file sharing capabilities for a wide variety of information (e.g. addresses, childcare provider information, doctor information, emergency contacts, immunization records), expense management tools and communication tools such as instant messaging. While the information within these classifications may be required for the use of specific services or features of the website, you are not required to use all of the services and features. Once you register with 1happystepmom and become a Member, you are not anonymous to us.

1happystepmom uses information that is collected about you (including children’s information) to customize the content and features you see, to fulfill your requests for certain products and services, to provide electronic notification services for events in your calendar, to communicate with you and for billing purposes. We may also use personally identifiable information (including children’s information) to help us improve the functionality and materials offered at 1happystepmom, as well as marketing and promotional purposes (e.g. we may ask users via a link to become fans of or to like us on a social network).

Information Sharing and Disclosure

Except as specifically stated herein, 1happystepmom will not share your personally identifiable information with third parties. We will never sell or rent your personally identifiable information to third-party marketing companies.

1happystepmom will send personally identifiable information about you to third parties when (1) we have to respond to subpoenas, court orders or legal process, (2) we find that your actions on our website violate the Terms of Use, (3) we have your consent to share the information, (4) we need to share your information to provide the product or service you have requested, or (5) we need to send the information to companies who work on behalf of 1happystepmom to provide a product or service to you. In the unlikely event of a bankruptcy, information may be transferred to a bankruptcy trustee or debtor in possession and then to a subsequent purchaser.

We retain personally identifying information collected from children for only as long as necessary to fulfill the purpose for which the information was collected and delete the information using reasonable measures to protect against its unauthorized access or use once it is no longer needed.

SPECIFIC PERSONS WITH ACCESS TO PERSONAL INFORMATION

As noted above, if payment is required for your level of use, we use a third-party payment processor to collect payment information from Members over 18 years of age and from Parents of Members under 18 years of age. The third party payment processor we presently use is 2checkout.com.

We share names, addresses, and last four of social security numbers, with a third-party company, Electronic Verification Systems, which assists us in Parental Verifications.

We also use IDL Web Host as our hosting provider.

Please also note that we reserve the right to monitor your compliance with the Terms of Use and may track your usage of 1happystepmom in order to confirm compliance with the Terms of Use. 1happystepmom does not collect geo-location information from its users that is precise enough to identify the name of the street and city in which the user is accessing 1happystepmom.

Security

We have implemented technical, administrative and physical security measures that are designed to protect Member information from unauthorized access, use, disclosure or modification.

For example, your 1happystepmom website Account Information is password protected for your privacy and security. It is your responsibility to keep your password confidential and not disclose it to any other person. You are responsible for all persons using your username and password. Please advise us immediately if you believe your username and password have been compromised.

1happystepmom uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the website, including the use of IDL Web Host to host information you provide to us in cloud-based servers. The technical processing and transmission of 1happystepmom, including your content, may involve (a) transmissions over various networks, and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Currently, 1happystepmom and its authorized third-party vendors and hosting partners process data (including possibly your personal information) on servers in the United States of America and possibly in other countries. In some cases, personal information may be processed and stored outside your own country, including without limitation in the United States.

Disputes; Arbitration; Waiver of Class Action
Except as set forth below, ANY DISPUTE OR CLAIM ARISING UNDER THIS PRIVACY POLICY OR RELATING IN ANY WAY TO YOUR USE OF THE 1HAPPYSTEPMOM WEBSITE WILL BE RESOLVED BY FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT; provided, however, that the following are exceptions to our agreement to arbitrate our disputes:
  1. Any claim that qualifies as a small claim in a court of limited subject matter jurisdiction must be brought in such court; and
  2. Any claim for injunctive relief may be brought in a court of competent jurisdiction to enjoin intellectual property infringement or misuse.

You may begin an arbitration proceeding by following the American Arbitration Association’s (AAA’s) filing requirements and mailing a request for arbitration and description of your claim to InCorp Services, Inc. 2338 W. Royal Palm Rd., Ste. J Phoenix, AZ 85021. The AAA’s Rules of Commercial Arbitration will apply (available at www.adr.org or by calling 1-800-778-7879). The arbitrator will have the power to rule on any challenge to its own jurisdiction or to the validity or enforceability of any portion of this agreement to arbitrate. Notwithstanding any of the foregoing, THE ARBITRATOR WILL NOT BE EMPOWERED AND DOES NOT HAVE THE AUTHORITY TO HEAR OR DECIDE ANY CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION, TO AWARD PUNITIVE OR EXEMPLARY DAMAGES OR TO AWARD ATTORNEYS’ FEES TO THE PREVAILING PARTY.

You may opt out of this agreement to arbitrate by providing written notice of your intention to do so to 1happystepmom within 60 days of the earlier of your first use of the website or your creation of a Member account. If you desire to opt out, please send written notice of your election to opt-out within the required time period to InCorp Services, Inc. 2338 W. Royal Palm Rd., Ste. J Phoenix, AZ 85021. Your written opt-out notice must be signed by you.

By using the 1happystepmom website, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Arizona, without regard to principles of conflict of laws, will govern this Privacy Policy and any dispute or claim of any sort that might arise between you and Interface. The prevailing party in any judicial action to enforce this arbitration agreement shall be entitled to a judgment that includes all fees and costs incurred in such action.
